Visit Aruba Chat is provided
by CaribMedia Marketing & Consultancy N.V. ("CaribMedia") as a free service
to users who agree to abide by the following terms and conditions. CaribMedia reserves the
right to change the nature of this relationship at any time and for any reason. Any user
who violates this Agreement may be permanently banned from using Visit Aruba Chat.
Rules for Visit Aruba Chat:
You are entirely responsible and liable for all activities conducted when using Visit
Aruba Chat. Here is a list of some of the violations which may result in being
(permanently) banned from using Visit Aruba Chat. You agree not to do any of the following
while in Visit Aruba Chat.
(1) harass, threaten, embarrass or cause distress or discomfort upon another Visit Aruba
Chat participant, or other individual or entity;
(2) transmit any information, data, text, files, links, software, chat, communication or
other materials that CaribMedia considers to be unlawful, harmful, threatening, abusive,
harassing, defamatory, vulgar, obscene, hateful, racially or otherwise objectionable;
(3) impersonate in Visit Aruba Chat any person, including but not limited to a Visit Aruba
Chat official or volunteer;
(4) disrupt the normal flow of dialogue in a Visit Aruba Chat room or otherwise act in a
manner that negatively affects other participants;
(5) post or transmit any unsolicited advertising, promotional materials, or any other
forms of solicitation in Visit Aruba Chat; and
(6) violate any applicable local, state, national or international law.
CONTENT MONITORING:
CaribMedia as a matter of policy does not prescreen or monitor all information or
dialogue, but CaribMedia has the right, but not the responsibility, to remove any
information or dialogue which is deemed in CaribMedia's sole discretion harmful,
offensive, or otherwise in violation of any rules CaribMedia has in place at the time.
DISCLAIMER OF WARRANTIES:
YOU EXPRESSLY AGREE THAT USE OF VISIT ARUBA CHAT IS AT YOUR OWN RISK. CARIBMEDIA SHALL NOT
BE RESPONSIBLE TO YOU FOR ANY CONTENT FOUND IN VISIT ARUBA CHAT. CARIBMEDIA EXPRESSLY
DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NONINFRINGEMENT. CARIBMEDIA MAKES NO WARRANTY THAT VISIT ARUBA CHAT WILL MEET YOUR
REQUIREMENTS, OR THAT VISIT ARUBA CHAT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR
FREE.
LIMITATION OF LIABILITY:
TO THE FULL EXTENT PERMISSIBLE UNDER THE APPLICABLE LAW, CARIBMEDIA SHALL NOT BE LIABLE
FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE
USE OR INABILITY TO USE VISIT ARUBA CHAT OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS
AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES
RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH VISIT ARUBA CHAT OR RESULTING FROM
UNAUTHORIZED ACCESS TO OR ALTERATION OF PROFITS, USE, DATA, OR OTHER INTANGIBLE
PROPERTIES, EVEN IF VISIT ARUBA CHAT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INDEMNIFICATION:
You agree to defend, indemnify and hold harmless CaribMedia, its affiliated companies, its
employees, contractors, officers and directors, from all liabilities, claims and expenses,
including attorney's fees, that arise from breach of the terms of this Agreement, or in
connection with, the transmission of any Information on Visit Aruba Chat or the Internet
by or through Visit Aruba Chat accounts.
TERMINATION:
You or CaribMedia may terminate your Account at any time for any reason. Once your Account
is terminated, you cannot access Visit Aruba Chat in any manner or for any reason without
the express written consent of CaribMedia, and you cannot assist in enabling a terminated
participant to access Visit Aruba Chat using or via your Account.
MISCELLANEOUS:
This Agreement shall be governed by and construed in accordance with the laws of Aruba,
and you agree to submit to the personal jurisdiction of the courts of Aruba for any cause
or action arising out of this Agreement. In the event that any portion of this Agreement
is deemed by a court to be invalid, the remaining provisions shall remain in full force
and effect.
